NCIS Recap 11/17/15: Season 13 Episode 9 "Day in Court"

Tonight on CBS NCIS returns with an all new Tuesday November 17, season 13 episode 9 called, “Day in Court” and we have your weekly recap below. On tonight’s episode, a petty officer tries to clear his name after his murder case is dismissed due to mishandled evidence.

Naval Petty Officer Kyle Friedgen and his attorney have approached the NCIS on tonight’s all new episode with an usual request.

Earlier Kyle had been arrested for the murder of his former girlfriend Joy Vanatter and, while he claimed he was innocent, there appeared to have been one piece of evidence that would have had spending him spending the rest of his life behind bars. However that one piece of evidence was thrown out because of an overzealous district attorney. So with nothing else to use against Kyle – Kyle was freed by the judge.

Yet Kyle didn’t necessarily recover his old life. For it seems the court of public opinion have already made up their minds about him and therefore there was not a single person in his life (besides his attorney that is) actually believes in his innocence. So after he was freed his fellow crew members onboard the ship then began to shun and his own wife started fighting him for custody over their unborn child.

So Kyle figured he really didn’t have anything to lose by then and that’s when his attorney came up with a drastic plan in order to help him. She told him that if the NCIS were to officially court-martial him then he could finally have a day in court. Where he could prove his innocence once and for all.

But the real question was what if Kyle actually did have something to hide? With an investigation officially opened, the team had to look at all the evidence as well speak with the lead detective on the case. And Detective Malone was a good friend of DiNozzo’s so DiNozzo didn’t doubt the other man when he said he ran the case by the book.

However he did wonder if the police might have only looked at Kyle so they did a little digging into Joy and Kyle’s past.

Joy and Kyle used to be a highly-strung and volatile couple but then one day they got pregnant. So it was that pregnancy that changed everything between them. Because after an abortion that essentially ended their relationship, Joy continued to spiral out while her ex managed to get his life together.

Therefore it was odd that the two them had exchanged texts and even calls on the day Joy was murdered. To put it simply, it did not make sense for Kyle to be in communications with someone from a very ugly part of his past. But Kyle said he never physically saw her before she died and that it had been years before they talked when out of the blue she began texting him.

So NCIS was investigating why Joy would do that when Abby found something interesting. She found footage from the day before Joy was murdered and she had proof that Kyle did see Joy.

The money he had withdrawn from his account was the exact same amount that was later found Joy. Thus there’s evidence of both him paying her as well his attempt at covering it up. And no shocker but that made Gibbs very angry.

Gibbs had felt his team had been used. There they were tirelessly working on helping Kyle yet Kyle had chosen to lie to them about a very important detail. So Gibbs turned over the evidence to the Baltimore police and they once again arrested Kyle for murder.

Kyle had denied seeing the victim but he did so that placed him at least near the crime. However Gibbs later found out that Kyle had been right about one thing – the syringe! The same syringe that had been found in Kyle’s car with his Joy’s blood on it. Only Abby and Ducky found out the drugs that had been in syringe were not the same ones that had been found in Joy’s system.

So someone did plant the syringe in Kyle’s car.

And Bishop and DiNozzo think it might have the prosecutor on Kyle’s case. Alan Wyner had prosecuted Joy a couple of years before her death and the syringe that had been collected at the time was found to be clean. As in absolutely clean of everything including the drugs that had allegedly been found in it two years ago.

Which meant Wyner had then set Kyle up only to then screw up over a small detail such as a warrant. So the team looked into him and that’s when everything just fell into place. Wyner had secretly been seeing Joy when one day she tried to get away from him and frantically called her ex Kyle asking for money. Poor Kyle hadn’t known what the money was for but knew Joy must be bad off if she was reaching out to him.

But Joy never got to make her escape. Her lover killed her and then tried to frame Kyle though he later said he had wanted to make it better by messing up on the warrant. And so Wyner didn’t understand why Kyle would then get an investigation reopened.

It was as if he couldn’t believe that Kyle wouldn’t be able to return to a normal life after getting off on a mere technicality.

Yet Kyle did get his freedom in the end and he now has to work on his marriage seeing as his wife had left him because she too thought he was guilty. And speaking of marital problems, Bishop and Jake might just be over for good. Jake had apparently cheated on his wife and so Bishop packed up her bags in order to return home to Oklahoma.
